California can’t require background checks to buy ammunition, appeals court rules
A federal appeals court has ruled that California’s law mandating background checks for ammunition purchases is unconstitutional. In a 2-1 decision, the Ninth US Circuit Court of Appeals upheld an earlier injunction against the enforcement of this law. Judge Sandra Ikuta stated that California did not demonstrate that the law aligns with the historical tradition of firearm regulation as required by a 2022 Supreme Court precedent. The ruling highlights that the background check system violates the Second Amendment by infringing upon the fundamental right to keep and bear arms. Although voters had approved a measure in 2016 to implement background checks and permit fees related to ammunition, the requirement for checks on each purchase was later modified.
