Appeals Court Blocks California’s Background Checks for Ammunition Buyers

The U.S. Court of Appeals for the Ninth Circuit has ruled that California’s law requiring background checks for ammunition buyers is unconstitutional, violating the Second Amendment. This decision, a 2-1 ruling issued on July 24, 2025, comes after a ballot initiative was approved by California voters in 2019, which mandated background checks akin to those for handgun purchases. The law aimed to prevent access to ammunition for individuals with criminal records, restraining orders, or mental health issues deemed dangerous. However, the requirement faced legal challenges, with prior rulings declaring it unconstitutional. The Ninth Circuit majority concluded that the background check regime infringes on the fundamental right to keep and bear arms.
