**Florida court revives couple’s lawsuit over gun range noise, citing constitutional rights**

A Florida appeals court has ruled that a 1999 law shielding gun ranges from noise complaints is unconstitutional, allowing an Okaloosa County couple, Eugene and Adrienne Gartman, to proceed with their lawsuit against a neighboring gun range. The Gartmans, who purchased their land in 1998, claimed noise from the range disrupted their peace. A prior ruling favored the gun range based on the 1999 statute, which stated that shooting ranges couldn’t be subject to nuisance claims if they were compliant with noise laws at construction. However, the appeals court found that this law infringed upon the Gartmans’ constitutional rights to seek legal recourse for damages. Still, the court clarified that while the lawsuit can move forward, it does not guarantee a successful outcome.
