**Appeals court rules on felony-firearm statute of limitations**
A recent ruling by the Michigan Court of Appeals determined that the six-year statute of limitations applies to felony-firearm convictions. This decision clarifies that charges of possessing a firearm during a felony—referred to as felony-firearm—have a distinct limit, separate from the limitations of the underlying “predicate felony.” Prosecutors had argued that since felony-firearm charges are contingent on another crime, the longer statute of limitations for that crime should apply. However, the court emphasized that felony-firearm is its own crime, asserting its unique time limit for prosecution. Christine Pagac from the Criminal Defense Attorneys of Michigan supported the ruling, stating it aligns with the statute’s language and reasoning.
