Ninth Circuit Expands Ruling Against California Gun Ad Ban

A Ninth Circuit Court of Appeals panel clarified its stance on California’s firearms advertising restrictions, declaring that a district court “abused” its discretion by issuing a preliminary injunction against the law. The panel stated that its prior ruling in Junior Sports Magazine Inc. v. Bonta applied to the entire statute, leading to the requirement that section (b) of California’s law, which dealt with claimed privacy protections for minors, also be blocked. This ruling reinstates companies’ rights to advertise firearms, even if such marketing appears “reasonably attractive to minors,” reinforcing claims by gun-rights advocates that the law violates the First Amendment. The decision comes after a challenging legal landscape for youth shooting sports in California, which faced significant operational disruptions due to the law.
