Federal appeals panel rules against handgun sales to buyers under 21
A federal appeals court has upheld a ban on handgun sales to people aged 18 to 20, marking a win for gun-control advocates. The ruling centers on whether a 1968 federal law barring such sales is constitutional following the Supreme Court’s 2022 decision in New York State Rifle and Pistol Association v. Bruen, which requires gun restrictions to be rooted in historical tradition.
The 4th Circuit Court reversed a previous federal judge’s ruling that declared the ban unconstitutional. The majority opinion stated that historically, handguns were prohibited from being sold to minors as early as the mid-1800s due to concerns about their maturity. In contrast, a dissenting opinion argued that the ban is inconsistent with the nation’s historical laws regarding firearms.
Lawyers for the plaintiffs plan to petition the Supreme Court for a review, citing conflicting rulings from different circuit courts.
