PA Court Upholds Gun Industry Protections
In a unanimous decision on March 31, 2025, the Pennsylvania Supreme Court ruled that the Protection of Lawful Commerce in Arms Act (PLCAA), passed in 2004, is constitutional and bars the lawsuit Gustafson v. Springfield, Inc. This case involves the tragic accidental shooting of a 13-year-old boy by a 14-year-old friend in 2016. The plaintiffs, the boy’s parents, alleged various defects against Springfield Armory and the store where the gun was purchased. Initially dismissed by the trial court due to the PLCAA, an appeal was made but was reversed by the Superior Court. Ultimately, the State Supreme Court upheld the PLCAA’s protections, reinforcing that the Act does not violate constitutional principles and emphasizes that the gun industry is not liable for the criminal misuse of firearms.
